Nursing homes are responsible for taking care of the elderly. If a company is in this category, it faced allegations of violating protections for resident health and safety and was fined or reached a settlement.

Violation Tracker contains roughly 38,500 entries on nursing home cases dating back to 2000, with almost $1.3 billion in penalties. Three-quarters of cases were handled at the federal level, primarily by the Centers for Medicare & Medicaid Services (CMS), which share oversight of nursing home regulation with state agencies. These cases relate primarily to resident health and safety. There are a small number of entries that involve defrauding the Medicare and Medicaid programs.

The remaining cases come from 34 state agencies plus the District of Columbia, along with state attorneys general. A handful of entries were handled by city attorneys in Santa Clara and Los Angeles. Many of the state agency entries were compiled through open records requests, though several states disclose enforcement actions publicly on their website. Cases from the state attorneys general were collected through press releases. 

Search Techniques

Violation Tracker offers multiple ways to locate nursing home cases.  In the Basic Search on the homepage, you can combine a company name with CMS in the Federal Regulatory Agency dropdown.  

The best way to access nursing home cases is through the Advanced Search page. Here you can combine a company name and/or other variables with the nursing home violation choice in the Offense Type dropdown. You can use the Full Text search box to search words or phrases related to nursing homes mentioned in the description field of the individual entries. Use the level of government dropdown to limit your search to federal, state or local cases.

On the Summaries page you can retrieve an overview of all healthcare cases (not just nursing homes) from the Offense Group dropdown. You can also find such overviews for the CMS or other agencies from the Federal Agency Summaries or State/Local Agency Summaries dropdowns. The parent company summaries include breakdowns by offense categories, including nursing home violations.
